Terms of Service

These Terms of Service ("Terms") govern your use of the website remarkableweb.co.nz and the web design, SEO, hosting, and related services ("Services") provided by Remarkable Web ("we", "us", or "our"). By using our website or engaging our Services, you agree to these Terms.

1. Our services

Remarkable Web provides website design and development, search engine optimisation (SEO), domain registration and management, website hosting, and ongoing website support. The specific services included in your plan are outlined on our Pricing page and in any agreement made between us.

2. Free website build

We build your website at no upfront cost. If you are not satisfied with the website we create, you are under no obligation to proceed and will owe us nothing. If you choose to go live, you agree to one of our monthly service plans.

3. Service plans and payment

• All plans require a 12-month minimum term from the date your website goes live.
• After the initial 12-month term, your plan continues on a month-to-month basis.
• Monthly fees are billed in advance and are due on the same date each month.
• All prices are listed in New Zealand Dollars (NZD) and are subject to GST (15%).
• We reserve the right to adjust pricing with 30 days written notice. Any price changes will take effect at the start of your next billing cycle.

4. Cancellation

• During the initial 12-month term, early cancellation may require payment of the remaining months on your plan.
• After the initial term, you may cancel at any time with 30 days written notice via email to hello@remarkableweb.co.nz.
• Upon cancellation, we will provide you with your website files and assist with transferring your domain to a provider of your choice, at no additional charge.

5. Website ownership

• You retain ownership of all content you provide to us (text, images, logos, branding).
• We retain ownership of the website code and design until the end of your initial 12-month term, at which point full ownership transfers to you.
• Your domain name is registered in your name and belongs to you at all times.
• We may feature your website in our portfolio and marketing materials unless you request otherwise.

6. Your responsibilities

As a client, you agree to:

• Provide accurate and timely information needed to build and maintain your website.
• Ensure that any content you provide does not infringe on any third-party intellectual property rights.
• Pay invoices on time in accordance with your chosen plan.
• Notify us promptly of any issues or required changes to your website.

7. Website updates

The number of website updates included each month depends on your plan:

• Starter: 1 update per month
• Growth: 5 updates per month
• Pro: Unlimited updates

An "update" is a reasonable change such as updating text, swapping images, adding a new section, or adjusting layout. Larger changes (such as building entirely new pages or features) may be quoted separately.

8. Hosting and uptime

We host your website on Cloudflare's global network, which provides fast load times and high availability. While we aim for 99.9% uptime, we do not guarantee uninterrupted service. We are not liable for downtime caused by factors beyond our control, including third-party infrastructure outages, DNS propagation delays, or force majeure events.

9. SEO services

Our SEO services are performed in good faith using current best practices. Search engine rankings are influenced by many factors outside our control, and we do not guarantee specific ranking positions, traffic levels, or business outcomes. We will provide regular reports so you can track progress.

10. Limitation of liability

To the maximum extent permitted by New Zealand law:

• Our total liability for any claim arising from our Services is limited to the total fees paid by you in the 3 months preceding the claim.
• We are not liable for any indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunities.
• We are not responsible for losses arising from content you provide, third-party services, or circumstances outside our reasonable control.

11. Intellectual property

All content on the Remarkable Web website (remarkableweb.co.nz), including text, graphics, logos, and design, is our intellectual property and may not be copied, reproduced, or distributed without our written permission.

12. Governing law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or our Services will be subject to the exclusive jurisdiction of the New Zealand courts.

13. Changes to these terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
